These terms and conditions apply to Baivina Pty Ltd ABN 96 169 067 074 (Baivina) online orders placed through the web site located at www.baivina.com.au and all associated websites linked to www.baivina.com.au. Please read these terms and conditions carefully.
By placing an order with Baivina Pty Ltd you agree to be bound by these terms and conditions.
CUSTOM MADE JEWELLERY
Custom made jewellery and loose diamonds, gemstones and pearls cannot be returned and an order cannot be cancelled once a deposit has been paid.
We recognise that it can be difficult to visualise how your finished piece will look and that some design changes might be required along the way to achieve exactly what you want. For this reason, we give you the opportunity to make small changes to the design before the stones are set, without incurring additional costs.
There are a number of alterations that are included in our service, such as changing the finger size where possible, making edges more rounded, reducing the width of a ring, etc, however if the changes are significant or the piece has to be remade, you may incur additional charges.
If an item has been finished to the requested specifications, further changes may incur a charge.
Custom made jewellery by Baivina Pty Ltd and its affiliates is guaranteed against any faults in materials or workmanship for the lifetime of the piece as long as any repairs are made by Baivina or its affiliates. Note, this does not include defects relating to general wear and tear, scratching, damage caused by accidents, neglect or misuse, or any resulting loss of the item or precious stones from the item.
A jewellery repair is considered to be any fixing of, or modification to an existing piece of jewellery not made by Baivina Pty Ltd or its affiliates or made by Baivina Pty Ltd and/or its affiliates but not covered under the guarantee.
In most cases we need to see the item required for repair before quoting on the job. Quotations are valid for five working days and are otherwise subject to change at any time at the discretion of Baivina Pty Ltd.
If you choose not to proceed with a quotation, any return shipping costs are the responsibility of you, the customer.
All repairs and modifications are undertaken with the greatest care of your piece with commitment to the quality of our workmanship. In some rare instances due to the age and/or very intricate and delicate nature of certain items Baivina may not be able to guarantee that no damage may occur during repair. In such rare instances you will be advised during quotation and reminded upon confirmation of your order that in such rare instances, Baivina cannot accept responsibility for any resulting damage.
For all custom made jewellery, a 50% deposit is required before a job can be started. You are required to pay in full upon collection or prior to dispatch of your item(s). All goods remain the property of Baivina Pty Ltd, until payment has been received in full.
For all repairs and modifications, payment must be made in full upon collection or prior to dispatch of your item(s).
Receipt of a direct transfer or a cheque is not deemed to be payment for goods until the funds have been received into our account. Please allow sufficient time for funds to clear before coming in to collect your item(s) as we are unable to release or ship the items until the funds have cleared.
Please take great care when entering our account details for direct transfers. Recovering funds transferred into a wrong account is a difficult, time consuming and costly process. Any payment into a wrong account is not deemed to be payment and the recovery of any funds transferred into a wrong account is the customer’s responsibility.

These terms and conditions and every transaction will be governed by and interpreted in accordance with Australian Law.
Our acceptance of your order brings into existence a legally binding contract between us. We reserve the right to cancel any order without giving reason or notice and will refund you the full amount.
The prices payable for goods are shown on your quotation and/or invoice and exclude GST and are in Australian Dollars.
The delivery prices for orders are set on a case by case basis and will be advised upon quotation. Items will be sent to the delivery address provided at time of order – it is your responsibility to ensure this is correct. If your order is returned to us because the courier or postal service could not complete the delivery to you for whatever reason, then you will be responsible for the repeat delivery costs. Please note that any import duty and taxes incurred for shipping to certain countries are the responsibility of the customer.

Baivina Pty Ltd ABN 96 169 067 074 (Baivina) is committed to providing our customers with a high level of privacy in relation to the personal information that is collected. Baivina provides the following privacy statement.
Personal Information collected and stored includes the customer's name, address, telephone number, facsimile number, e-mail address and credit card details. Baivina does not use or disclose the customers personal information collected for any other purpose other than performing all aspects of completing quotations and orders, and all ancillary correspondence in relation to orders without firstly gaining the customers consent, or where it is required by law or is required to satisfy our Terms and Conditions.
When Baivina's website is accessed, its internet service provider makes a record of the following internet data for statistical purposes:
- The customer's server address
- The customer's top level domain name (for example .com, .gov, .au, .nz etc)
- The date and time of the customer's visit to the site
- The pages the customer accessed and documents downloaded
- The previous site the customer has visited
- The type of browser the customer is using
Cookies may be placed in the customer's browser file on the customer's hard drive.
The customer's e-mail address may be recorded during any business with Baivina and may be recorded if the customer sends an e-mail message to Baivina. Under no circumstances will the customer's e-mail address be added to a 3rd party mailing list or used for any other purpose without the customer's consent being obtained or where it is required by law.
Baivina is committed to keeping secure the data a customer provides and Baivina will take all reasonable precautions to protect the customer's personally identifiable information from loss, misuse or alteration.
At the customer's request Baivina can provide the customer with access to the personal information Baivina holds about the customer. Access is limited to Baivina's record of the customer's address, contact details, accounts with Baivina and balances and statements relating to those accounts.
